In Erin Schilling's recent Bloomberg Tax article "IRS Voluntary Disclosure Update May Fail to Lure Rich Tax Cheats," firm partner Josh O. Ungerman offers insight into why proposed changes to the IRS's criminal voluntary disclosure practice may discourage, rather than encourage, taxpayer participation. Mr. Ungerman explains that requiring taxpayers to admit willful tax evasion before knowing whether they will be accepted into the program creates significant risk, warning that it is a "huge risk that many, if not most taxpayers with good counsel simply will not take."
