In his latest article with Bloomberg Tax, "Sidelining IRS's Criminal Tax Counsel Would Harm Taxpayers," firm partner Joseph A. Rillotta discusses how sidelining the criminal-tax counsel within the Internal Revenue Service would harm taxpayers. He warns that the planned changes, resulting in the IRS’s Office of Chief Counsel playing a reduced role in vetting criminal tax prosecutions, risk eroding key protections built into tax-crime-investigation procedures. Since tax investigations involve intrusive collection of financial data and prosecutors wield “great power,” the independent counsel function acts as a critical “devil’s advocate” to safeguard fairness, accuracy and uniform enforcement. With the dissolution of the Department of Justice Tax Division also hanging in the balance, Mr. Rillotta cautions that taxpayers may face baseless charges or flawed prosecutions if oversight weakens.
